Privacy Policy

1. Who we are 

Digital Lane Co. is the trading name of The Trustee for the Navarro Family Trust, ABN 99 716 074 031, of Central Coast, New South Wales, Australia. In this policy, "we", "us" and "our" mean Digital Lane Co. 

We take privacy seriously and handle personal information in line with the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth), whether or not we are currently required to. This policy explains what we collect, why, who we share it with, and how you can access, correct or complain about it. 

2. What this policy covers 

This policy applies to personal information we collect through our website, our booking and enquiry forms, our proposals, and while delivering our services. It covers three groups of people: 

  • Enquirers and prospects: people who contact us, book a call or download something 

  • Clients: businesses, agents and offices who engage us 

  • Third parties whose information passes through us, for example, leads generated by campaigns we run in a client’s ad account 

3. What personal information we collect 

We collect only what we need to run the business and deliver the work. 

Directly from you 

  • Name, business name, email address, phone number and suburb 

  • Your role, the type of business you run, and what you are trying to achieve 

  • Booking details and anything you tell us on a call or in an email 

  • Brand assets you send us: logos, colours, photographs, headshots and video footage, which may contain images of you and your team 

  • Billing contact details. We do not collect or store your credit card number; payments are handled by our payment provider 

Through platforms you give us access to 

  • Facebook, Instagram and Meta Business Manager data: page insights, audience and campaign performance 

  • Google Business Profile data, where that service is included 

  • Website and pixel analytics on properties you own 

  • Lead and enquiry data captured by campaigns and capture pages we build for you 

Automatically, when you use our website 

  • IP address, browser and device type, pages viewed and referring source 

  • Cookie and pixel data, including the Meta pixel and Google Analytics, subject to your cookie choices 

We do not seek sensitive information as defined in the Privacy Act. Please do not send us health, biometric, racial or ethnic, political, religious, sexual orientation or criminal record information. If you do, we may delete it. 

4. How we use it 

  • To respond to enquiries, prepare proposals and book calls 

  • To deliver the services you have engaged us for 

  • To build, run, optimise and report on advertising campaigns in your own accounts 

  • To invoice you and manage our account with you 

  • To send you service messages about your account, which are not marketing 

  • To send marketing communications where you have consented or where it is reasonably expected, always with an unsubscribe option 

  • To improve our own services and website 

  • To meet legal, tax and record-keeping obligations 

5. Who we disclose it to 

We do not sell personal information. We disclose it to the following categories of recipient, only as needed: 

  • Our delivery team may be outside of Australia, who produce content, edit video and manage campaigns on our behalf under confidentiality obligations 

  • Advertising and social platforms: Meta Platforms and Google, where campaigns and profiles are run 

  • Software and hosting providers: our CRM and landing page platform, email provider, file storage, scheduling tools and website host 

  • Payment and accounting providers: for invoicing and reconciliation 

  • Professional advisers: our accountant and, if needed, our lawyers 

  • Anyone else with your consent, or where we are required or authorised by law 

6. Overseas disclosure 

Some of the people and systems we use are located outside Australia. Specifically: 

  • Members of our delivery team are located in the Philippines 

  • Several of our software providers store data in the United States and other countries 

Before disclosing personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles, including through confidentiality and data handling terms in our contracts. By engaging us or providing information to us, you acknowledge that your information may be accessed from these locations. 

7. Information we handle on behalf of clients 

When we run campaigns, capture pages or databases inside a client’s own accounts, the client remains responsible for that data and for its own privacy obligations to the individuals concerned. We act on the client’s instructions, we do not use that data for our own purposes, and we do not take a copy for ourselves. 

Every account, pixel, audience, asset and data point we build in your accounts remains yours. If our engagement ends, it stays with you and we remove our access. 

8. Marketing and the Spam Act 

We only send commercial electronic messages where we have your consent or where consent is reasonably inferred from an existing business relationship, as permitted under the Spam Act 2003 (Cth). Every marketing message identifies us and includes a working unsubscribe link. Unsubscribing takes effect within five business days and does not affect service messages about work in progress. 

9. Cookies and tracking 

Our website uses cookies and similar technologies to make the site work, to measure how it is used, and to support advertising. This may include the Meta pixel and Google Analytics. You can refuse or delete cookies through your browser settings, though some parts of the site may not work as well. Where a cookie banner is shown, your choices are respected. 

10. Security 

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, including access controls, multi-factor authentication on business systems, reputable hosted platforms and limiting access to those who need it. No system is perfectly secure, and we cannot guarantee absolute security. 

11. Data breaches 

If a data breach occurs that is likely to result in serious harm, we will act promptly to contain and assess it, notify the individuals affected and, where the Notifiable Data Breaches scheme applies to us, notify the Office of the Australian Information Commissioner. If the breach affects a client’s account, we will tell the client as soon as we reasonably can so they can meet their own obligations. 

12. How long we keep it 

We keep personal information only as long as we need it for the purpose it was collected, plus any period required by law. Financial records are kept for at least seven years to meet Australian tax requirements. Prospect enquiry records are generally kept for two years from last contact. Creative files and campaign data in your own accounts stay with you and are not ours to retain or delete. 

13. Accessing and correcting your information 

You can ask us for a copy of the personal information we hold about you and ask us to correct anything that is wrong. Email us at [email protected]. We will respond within 30 days. There is no charge for making a request. We may need to verify your identity first, and in limited circumstances permitted by law we may decline a request, in which case we will explain why. 

14. Complaints 

If you think we have mishandled your personal information, contact us first at [email protected] with the details. We will acknowledge within five business days and aim to resolve it within 30 days. 

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au, by phone on 1300 363 992, or by writing to GPO Box 5218, Sydney NSW 2001. 

15. Changes to this policy 

We may update this policy from time to time. The current version is always on our website with the date it was last updated. If we make a significant change affecting how we handle your information, we will tell current clients directly.
